Acceptance
By downloading, installing, or using the attiq.io app or website (the Service) you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. The Service is operated by Net Gains, Inc.
Description of Service
attiq.io is a mobile application that uses artificial intelligence to help users identify antiques and collectibles, estimate resale value, post listings to eBay, Depop, and Mercari in one tap, and publish shareable public pages for items the user chooses to share. The Service is available on iOS and is offered in both a free tier and a paid subscription tier (attiq.io Pro).
AI estimates and disclaimers
Value estimates, authenticity scores, pricing curves, and all other outputs generated by the Service are produced by AI models and are provided for informational purposes only. They are not professional appraisals, certified valuations, or financial advice. We make no warranty, express or implied, regarding the accuracy, completeness, or fitness for any particular purpose of any estimate or output. You should verify any estimate independently before making buying, selling, or donating decisions based on it. For items of significant value, obtain a professional appraisal.
Subscriptions and payments
attiq.io Pro is available as a monthly or annual auto renewing subscription, processed through Apple App Store. By subscribing you authorize the applicable charge on a recurring basis. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. You may manage or cancel your subscription at any time through your Apple ID account settings. We do not issue refunds except as required by applicable law or Apple standard refund policy. Prices are subject to change with notice.
User responsibilities
You agree to use the Service only for lawful purposes. You must not use the Service to identify, acquire, or sell stolen goods, or to knowingly misrepresent counterfeit items as authentic. You are solely responsible for the accuracy of any listing you post to a third party marketplace and for all transactions you enter into. You must be at least 13 years old to use the Service.
Community content and conduct
attiq.io lets you publish items, photos, and profile details that other people can see, and lets buyers contact sellers. There is zero tolerance for objectionable content or abusive behavior. You must not post content that is illegal, counterfeit, stolen, hateful, harassing, sexually explicit, violent, or that infringes anyone's rights, and you must not harass, threaten, or spam other users. You can report any item from inside the app, and you can block any seller so you no longer interact with them. We review reports and remove content, and we may suspend or remove users who violate this policy, typically within 24 hours of a report. We may remove any content or account at our discretion. To report objectionable content or abusive behavior you cannot resolve in the app, email [email protected].
Intellectual property
The Service, including its software, design, and content, is owned by Net Gains, Inc. and protected by applicable intellectual property laws. You retain ownership of photos you take with the Service. By submitting a photo for identification you grant us a limited, temporary license to process it solely for the purpose of returning a result to you, and we do not retain that photo afterward. Separately, when you choose to publish an item to your public attiq.io page, you grant us a license to store, host, and publicly display that item's photo, its value, and the profile details you provide, for as long as the listing stays published, so the public page can be served and shared. Removing the item or your profile ends that license and takes the page down.
Third party services
The Service integrates with third party providers including Anthropic (AI processing), Vercel (hosting), RevenueCat (subscription management), and eBay (marketplace data and affiliate links). Your use of those services is subject to their respective terms and privacy policies. We are not responsible for the availability or conduct of any third party service.
Affiliate links
Links to eBay and other marketplaces may include affiliate tracking identifiers. If you complete a qualifying purchase through such a link, we may earn a commission at no additional cost to you.
Referral program
attiq.io offers a referral program. Users may share a personal referral code or link of the form attiq.io/r/CODE. Referrals are used for attribution. Any referral reward, where offered, is described at the point of the offer, may change or end at any time, and has no cash value. We reserve the right to decline a referral or terminate participation for abuse, including but not limited to self referral, automation, and use of multiple devices to game the program.
Privacy
Our collection and use of information is described in our Privacy Policy, which is incorporated into these Terms by reference.
Disclaimer of warranties
The Service is provided as is and as available without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non infringement.
Limitation of liability
To the maximum extent permitted by applicable law, Net Gains, Inc. and its officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits or data, arising from your use of or inability to use the Service. Our total liability to you for any claim arising from these Terms or your use of the Service shall not exceed the amount you paid us in the twelve months preceding the claim, or $10, whichever is greater.
Indemnification
You agree to indemnify and hold harmless Net Gains, Inc. from any claims, damages, or expenses (including reasonable attorneys fees) arising from your use of the Service, your violation of these Terms, or your violation of any third party rights.
Changes to these Terms
We may update these Terms from time to time. We will post the revised Terms at attiq.io/terms with an updated date. Your continued use of the Service after any change constitutes your acceptance of the new Terms.
Governing law
These Terms are governed by the laws of the United States applicable to agreements made and performed entirely within the United States, without regard to conflict of law principles.
